Legal and Contractual Principles for Evaluating EOT and Cost Claims

Few construction projects finish on time, and most delays lead to claims. Evaluating them is difficult. Notices are late or incomplete, programmes are not updated, records are missing, and claims mix entitlement, delay and quantum in a single document. Employers and engineers may reject valid claims or accept weak ones because they lack a consistent method, while contractors submit claims that fail on procedure rather than merit. The outcome is delayed payment, strained relationships and disputes that could have been avoided.

This programme follows the logic of a sound evaluation. It starts with the contractual and legal framework, moves to notices, time bars and records, then to establishing entitlement and analysing delay, then to evaluating the associated costs, and finally to determination, negotiation and dispute avoidance. The focus is on the questions an evaluator must answer and the evidence needed at each step.

Built on recognised practice. The programme references the FIDIC 2017 Red and Yellow Books, including the extension of time and claims provisions, the NEC4 compensation event mechanism, the Society of Construction Law Delay and Disruption Protocol (2nd edition), AACE International Recommended Practice 29R-03 on forensic schedule analysis, and general legal principles such as the prevention principle, concurrent delay and good faith, as they apply in common law and civil law systems, including those in the GCC.

Decisions this programme improves. Whether a claim satisfies the contractual notice and substantiation requirements; whether the event is at the employer's or the contractor's risk; which delay analysis method is suitable for the records available; how to deal with concurrent delay; which cost heads are recoverable; and when to settle, determine or refer a claim.

How it is delivered. Twenty hours across five sessions, built around one running case: an infrastructure contract with late access, design changes and a contractor claim for time and money. Participants review notices and records, test the entitlement argument, compare delay analysis results and evaluate quantum, before preparing a reasoned determination.
