Planning, Negotiating and Managing Performance-Based Contracts
This course aims to develop participants’ ability to plan, negotiate and manage performance-based contracts that clearly define expected outcomes, service levels, responsibilities, risks, KPIs, incentives, penalties, governance mechanisms and continuous improvement requirements.
Performance contracts are increasingly used to ensure that suppliers, service providers, departments and project teams are accountable for measurable results rather than only activities or inputs. Effective performance contracting requires clear planning, well-defined outcomes, realistic KPIs, balanced risk allocation, strong negotiation skills and disciplined contract management.
This course provides a practical approach to designing and managing performance contracts from planning to negotiation, implementation, monitoring and review. Participants will learn how to define contract objectives, develop service levels, establish performance indicators, negotiate commercial and operational clauses, manage contract risks, review performance data and handle underperformance.
The course reflects current practices in outcome-based contracting, service-level agreements, supplier performance management, data-driven contract monitoring, digital dashboards, ESG-related performance requirements, agile contract governance and the responsible use of technology and AI tools in contract administration.

Contracts rarely fail at signature. They fail in administration: obligations nobody tracked, notices sent late, changes agreed informally and records that cannot support a position. This programme gives contract practitioners a disciplined method to manage obligations, control change, handle claims and disputes, and close contracts cleanly with the commercial position protected.
Claims and disputes are expensive because they are usually prepared too late, with weak records and a poor reading of the contract. This programme gives practitioners a structured approach to preventing, preparing, assessing and resolving contractual claims, from notices and time bars to negotiation, dispute boards, mediation and arbitration.
Purchasing decisions made without sound cost analysis, clear contract terms or disciplined supplier evaluation cost organisations money long after the order is placed. This programme strengthens the core knowledge a purchasing professional needs, from the purchasing process and pricing to negotiation, contracts and inventory, and prepares participants for the Certified Purchasing Professional (CPP) examination.
