Administrative contracts differ from private contracts. The public entity holds special powers to supervise, modify, impose penalties and terminate in the public interest, while the contractor is protected by principles such as financial equilibrium. The validity of the contract also depends on strict procedures: approved budgets, proper tender methods, equal treatment of bidders, correct evaluation and award, and authorised signature. Errors at any stage expose the entity to grievances, audit findings and disputes that begin long before work starts.

This programme follows the conclusion of an administrative contract in sequence. It starts with the legal nature and governing principles of administrative contracts, moves to planning and choosing the contracting method, then to tender documents and the tendering process, evaluation, award and signature, and finally to the rights and obligations that follow and the resolution of disputes.

Built on recognised practice. The programme draws on the administrative law tradition that shapes public contracting in many Arab jurisdictions, national government tenders and procurement laws and their implementing regulations, the UNCITRAL Model Law on Public Procurement and the OECD Recommendation on Public Procurement. Participants compare these principles with the rules that apply in their own jurisdiction.

Decisions this programme improves. Which contracting method is lawful and suitable; what the tender documents must contain; how to handle clarifications, extensions and late or non-compliant bids; how to evaluate and justify an award; when to negotiate or cancel a tender; which guarantees and conditions to require before signature; and how to respond to a bidder's grievance.

How it is delivered. Twenty hours across five sessions, built around one running case: a public entity contracting for a multi-year services project, from needs approval through tendering, a disputed evaluation and a bidder grievance to contract signature. Participants review tender clauses, complete an evaluation report and draft responses to procedural challenges.
